Does the warranty transfer when you buy a used phone?
Manufacturer warranty, protection plans and seller warranties follow different rules. Here is what Apple and Samsung India actually say, and the paperwork to ask for before you pay.
Quick answer: Often, yes, but the details matter. For an iPhone, Apple's one-year warranty runs from the original retail purchase and doesn't say it's limited to the first buyer. Apple checks coverage by serial number, but it may ask for proof of purchase. AppleCare plans can be transferred only in some cases. For Samsung phones in India, the warranty terms don't restrict phones to the first buyer, though proof of purchase is a pre-requisite. Samsung Care+ can't be transferred. Either way, ask the seller for the original invoice.
Three different things people call "warranty"
When a seller says "still under warranty", they could mean any of these:
- The manufacturer's warranty that comes with a new device. It is usually one year for phones.
- An extended protection plan such as AppleCare+ or Samsung Care+, bought separately.
- A seller's or refurbisher's own warranty, honoured by that business, not the brand.
Each has its own transfer rules. Ask which one they mean.
Apple: the limited warranty
Apple India links to Apple's standard one-year limited warranty for iPhone. It covers defects in materials and workmanship for one year from the date of original retail purchase by the end user. The text doesn't mention transfer and doesn't limit coverage to the first owner. Experienced volunteers on Apple's community forums say the warranty follows the device, not the owner, and is looked up by serial number. In practice, a second owner gets whatever time is left. That is a community answer, not an Apple policy statement, and the proof-of-purchase clause below still applies.
Some points in the same document matter for second-hand buyers:
- Proof of purchase may be required. Apple says it may ask for proof of purchase details before giving service.
- Country restriction. Apple may restrict iPhone warranty service to the country where Apple or its authorised distributors originally sold the device. An imported phone bought in India may not get warranty service here.
- Third-party repairs. The warranty doesn't cover damage caused by service from anyone other than Apple or an Apple Authorised Service Provider, or products modified without Apple's permission.
- Stolen or locked devices. Apple may refuse service if authorities or registries report the device as stolen. It may also refuse if you can't turn off security features like the passcode and can't show you are the authorised user.

Apple: AppleCare plans
AppleCare is separate, and Apple's transfer page sets conditions:
- The current owner starts the transfer. They need the AppleCare agreement number, the device serial number and the proof of coverage, all from Apple's My Support. They also need the device's original sales receipt and the new owner's name, address, email and phone number. Then they contact Apple Support.
- If the plan is paid monthly or annually and is linked to an Apple Account, it can't be transferred.
- Apple adds that some plan types, in some countries or regions, can't be transferred.
So for a used iPhone with AppleCare, arrange the transfer with the seller before the sale, while you can still reach them. Apple's transfer page doesn't mention India specifically, so check with Apple Support India if the plan matters to your decision.
Samsung India
Samsung India's warranty page gives mobile handsets a 12-month warranty. The first line of its terms for mobile phones reads: "Proof of purchase is a pre-requisite to claim warranty."
- No first-purchaser limit for phones. The page does limit warranty to the first purchaser, and makes it non-transferable, for notebooks and memory and storage devices. It doesn't say this for mobile phones.
- Invoice date. If a product is registered without an invoice date, Samsung's system counts the warranty from the manufacturing month. The actual date is checked against the purchase invoice.
- Country of first sale. Samsung limits service for smartphones, tablets and watches to the country where the product was first sold. A service centre elsewhere may still check whether it can repair an imported phone.
- Samsung Care+ is not transferable. Samsung says the plan is tied to the registered device's IMEI or serial number.
So a second-hand Samsung phone can still be under warranty in principle. In practice, you'll usually need the seller's original invoice to use it.
Other brands and refurbished phones
Terms differ by brand and product category, as Samsung's own notebook rule shows. Before you rely on "still under warranty", read the brand's official India warranty page for that product. Check three things: whether warranty is limited to the first purchaser, whether proof of purchase is required, and whether service is limited to the country of sale.
For refurbished phones, find out whose warranty it is. Samsung's Certified Re-Newed phones in India come with a one-year warranty from Samsung. Most other refurbished phones carry the seller's own warranty. That's only as good as the seller's willingness and ability to honour it, so get the terms in writing.
